1.1 These terms and conditions regulate the terms and conditions of use of the Online Shop mirumloft.com
1.2 The Internet Shop operating at the address mirumloft.com (hereinafter referred to as: mirumloft.com Internet Shop) is operated by PrzedsiÄ™biorstwo Handlowo UsÅ‚ugowe “MIRUM” Marcin Wandas, entered in the National Court Register kept by the District Court in Rzeszów, Poland.

1.4 The Terms and Conditions of the mirumloft.com online shop are placed continuously on the mirumloft.com website in a way that allows customers to obtain, reproduce and record its content.
- 2 Definitions
The terms used in these terms and conditions mean:
2.1. Consumer – it is a natural person within the meaning of Article 221 of the Civil Code,
2.2 Entrepreneur on the rights of a consumer – it is a natural person concluding a contract directly related to his/her business activity, when the content of this contract shows that it does not have a professional character for this person, in particular resulting from the subject of his/her business activity, made available on the basis of the provisions of the Central Register and Information on Business Activity,
2.3 Entrepreneur – means a natural person, a legal person or an organisational unit which is not a legal person, to which the Act grants legal capacity, conducting in its own name a business or professional activity and performing a legal action directly related to its business or professional activity,
2.4 Service Provider/Seller – PrzedsiÄ™biorstwo Handlowo UsÅ‚ugowe “MIRUM” Marcin Wandas, NIP 8133426268 , REGON: 383364870.
2.5 Online Shop – online shop operated at mirumloft.com by – PrzedsiÄ™biorstwo Handlowo UsÅ‚ugowe “MIRUM” Marcin Wandas,
2.6 Civil Code – the Act of 23 April 1964 (Journal of Laws 2020.1740),
2.7. Product – Item available in the Online Shop .Product is a newly restored old item displayed with photos by the Seller.
2.8 Rules and Regulations – these rules and regulations for the provision of services by electronic means within the meaning of Article 8 of the Act on the provision of services by electronic means of 18 July 2002 (Dz.U.2020.344),
2.9 Customer/Purchaser – a natural person, a legal person or an organisational unit that is not a legal person, to which special regulations grant legal capacity, who makes or plans to make an Order within the framework of the Internet Shop using electronic means, including also a Consumer, Entrepreneur on the rights of a Consumer and Entrepreneur,
2.10. Order – Customer’s declaration of will, in which the Customer accepts the Seller’s sales offer, which includes in particular the price, type, quantity of the Products under the Sales Agreement via the Internet Shop.
2.11. Sales Agreement – a contract of sale of a Product concluded or entered into between the Customer and the Seller via the Online Shop.
2.12. Consumer Rights Act – the Consumer Rights Act of 30 May 2014 (Dz.U.2020.287).
- 3 Rules for the use of the Online Shop
3.1 The prices of all Products in the Online Shop are gross prices (including VAT) and are expressed in EURO and USD.
3.3 It is not necessary to accept these Terms and Conditions to place an order in the online shop.
3.4 In order to effectively place an order in mirumloft.com online shop, it is necessary to have a device with Internet access to browse the Internet, as well as a keyboard or other device to correctly fill out electronic forms. It is recommended to use the latest versions of web browsers: Firefox, Chrome, Internet Explorer, Microsoft Edge, Opera, Safari for OS X, etc.
3.5 The Shop website uses Responsive Web Design (RWD) technology, which adapts the content of the website to the device on which it is displayed. The Shop website is prepared to be displayed both on desktop computers and mobile devices.
3.6. mirumloft.com e-shop website has an SSL certificate – a secure protocol for encrypting communication.
- 4 Conditions for concluding a sales contract
4.1 Orders in the online shop mirumloft.com can be made by completing the appropriate forms available on the shop’s website.
4.2 When placing an order, the customer is obliged to provide correct personal data: name, surname, address, e-mail address and mobile phone.
4.3 Once the order is received, the Seller contacts the buyer and establishes the exact price for shipping to his Locality . Only after stating the amount for delivery , the Buyer pays the amount for the product and delivery to the Seller . Once the money has been received in the seller’s account, the contract is considered concluded .
4.4 Making available and recording the content of the contract of sale is done by making these Terms and Conditions available on the website of the Online Store mirumloft.com.
4.5 Making Orders in mirumloft.com Online Shop is possible 24 hours a day, all days of the year.
- 5 Method of payment and payment term
5.1 In the shop mirumloft.com there is only one possible way of payment
– transfer to the Seller’s bank account,
5.2 After placing an order, the Customer receives by e-mail the number of the bank account to which the correct amount should be transferred. The Seller then contacts the Customer and agrees with the Customer the exact amount for the delivery. As soon as the amount for delivery is set and the payment is credited to the mirumloft.com shop’s bank account, the order is forwarded for execution.
5.3 The customer is obliged to make payment for the order within 14 working days from placing the order.
- 6 Delivery
6.1. The ordered Products are delivered anywhere in the world, but after the delivery price is agreed with the Customer, the delivery takes place at the address indicated by the Customer in the order form after the Seller’s approval.
6.2 Shipping time of mirumloft.com shop is about 5-25 working days. If the Product cannot be delivered within the aforementioned time, the Buyer will be informed immediately.
6.3 The delivery of the ordered Products takes place via:

6.4 When the Product is handed over to the courier company, the Buyer is notified by sending an email to the address provided in the order. However, sometimes such information may not be received.
6.5. The costs of delivering the Product, which are to be borne by the Customer in addition to the price of the Product, are given by the seller contacting him after the order has been placed.
6.6 Upon receipt of the Product, the Customer is obliged to confirm its receipt. From that moment on, the Product becomes the property of the Customer.
- 7 Withdrawal from the contract
7.1 A consumer who has concluded a contract remotely may withdraw from the contract within 14 calendar days without giving any reason and without bearing any costs, except for the costs of delivery incurred by the SELLER.
7.2 In order to exercise the right referred to in the preceding paragraph, the Consumer shall inform the SELLER by submitting a declaration of withdrawal from the contract. The declaration may be sent by e-mail to the Seller’s e-mail address contact@mirumloft.com.
7.5 The Consumer shall bear the direct costs of returning the Product. The Consumer is obliged to duly secure the returned Product in order to prevent its possible damage during transportation.
7.6 The Consumer is obliged to return the Product immediately, but no later than within 14 days from the date on which he or she withdrew from the contract. The Seller may stipulate that in the event of withdrawal from the contract, the Product to be returned shall be collected by him or a person authorised by him. Return of the Product should be made to the address Karolówka 36 , 36-065 Dynów , Poland.
7.7 The Consumer shall be liable for any diminished value of the Product resulting from the use of the Product beyond what is necessary to ascertain the nature, characteristics and functioning of the Product.
7.8. In the case of withdrawal from the agreement all payments made by the Consumer, including the costs of delivery of the Product (except for the costs of delivery), will be refunded by the Seller immediately, but no later than within 14 days from the date of receipt by the Seller of the Buyer’s statement of withdrawal from the agreement. The payment shall be refunded using the same method of payment used by the Consumer. The Seller, in consultation with the Consumer, may agree on a different method of return that will not incur additional costs for the Consumer. If the Seller has not stipulated that it will collect the Product from the Consumer itself, it may withhold reimbursement until it has received the Product back or the Consumer has provided evidence of its return, whichever event occurs first.
7.11. The right of withdrawal shall not apply in the case of sending back an item damaged by the Buyer or from other matters not agreed upon with the Seller .
7.12. The provisions of this paragraph 7 concerning the Consumer shall also apply to Entrepreneurs on the rights of the Consumer.
- 8 Complaints
8.1 The basis and scope of the Seller’s liability towards the Customer are defined by the generally applicable provisions of law and the following provisions of the Terms and Conditions. Additional information regarding the Seller’s liability for the Product’s conformity with the Sales Agreement provided by law is indicated below:
In the case of a complaint about a Product – purchased by the Customer on the basis of a Sales Agreement concluded with the Seller until 31. December 2022, the Seller’s liability is determined by the provisions of the Civil Code in the wording in force until 31. December 2022, in particular Articles 556-576 of the Civil Code. These provisions define in particular the basis and scope of the Seller’s liability towards the Customer if the sold Product has a physical or legal defect (warranty). Pursuant to Article 558 § 1 of the Civil Code, the Seller’s liability under warranty for the Product purchased in accordance with the preceding sentence towards the Customer who is not a Consumer shall be excluded.
8.2 In the case of finding any mechanical damage, which occurred during the delivery or in the case of any other complaint to the Seller, the Buyer should send the report in writing and photos to the e-mail address contact@mirumloft.com.
8.3 In the complaint, it is recommended to indicate: the defect that, according to the Customer, the Product has, and if possible – to document the said defect, the date when the defect occurred, request for the method of bringing the Product into conformity with the agreement or any other claim of the Customer and provide contact details. The above requirements are recommendations, their lack does not affect the effectiveness of the complaint.
8.4 The Seller shall respond to the complaint within 25 days from the receipt of the complaint.
8.5 The above provisions relating to the Consumer shall also apply to Entrepreneurs on the rights of the Consumer.
8.7 The Customer who is a Consumer has in particular (but not exclusively) the following examples of out-of-court complaint and redress procedures:
- 10 Personal data
10.1 The Seller is the administrator of personal data.
10.2 The principles of personal data protection are contained in the Privacy Policy of mirumloft.com online shop available at mirumloft.com.
- 11 Final provisions
11.1 The Seller reserves the right to make changes to these Terms and Conditions for important reasons. Any amendments to the Terms and Conditions of Use shall come into force on an appropriate date indicated by the Seller, but not shorter than 7 days.
11.2 The amended Terms and Conditions shall be binding for the Buyer/Customer if the requirements specified in Article 384 and 384[1] of the Civil Code have been complied with, i.e. the Buyer/Customer has been correctly notified of the amendments and has not terminated the agreement within 14 calendar days from the date of notification.
11.3 Pursuant to Article 8 (3) (2) (b) of the Act of 18.7.2002 on the provision of services by electronic means, the entity using the website of the Internet Store is obliged not to place on this website content of an unlawful nature.
11.4 In matters not regulated by these regulations, the relevant provisions of the Civil Code and the Act of 30.5.2014 shall apply. – on consumer rights.

1.6 Contracts with the seller shall be concluded in English.
11.7 The Terms and Conditions shall enter into force on 15.04.2023.
